Cairns v Modi

There is some other case going on between India and Italy which made me think, how can English courts rule on something that happened in India :rolleyes Neither of these are British Citizens as well. Should they not be fighting this case in India?

That point has definitely been made over here. The problem is that London has become the libel capital of the world which is great for lawyers but makes the country look a bit ridiculous.
The case can be heard in the UK as it was shown that 34 people in GB had read Modi's initial tweet.
The legal point therefore is that he defamed him in Britain so Cairns can seek redress here.
 
by having a non-corrupt judge unlike in India, Modi can get his ass well and truly handed to him.

Do you mean to say that all Indian judges are corrupt and all non-Indian judges are honest ? Sweeping generalizations are not good.

Cairns wins so now we can officially call Modi a libeller (although not a lot else without being sued for libel by him).
As I've said had Modi won this would have been seismic for cricket. The real winners of course are the highly paid high court lawyers...
 
So I will go back to the title to what I originally had for this thread but just slightly alter it "Cairns vs Modi the liar pig".

I despise that man so much. And to think for a couple of years he was treated like a God. Just like Stanford. All these businessmen who come in and try and milk 20/20 for every penny are the same, yet for some reason things like the IPL still get such support. When will people wake up and realise this will keep on happening, people like Modi and Stanford are just one of many, and things like the IPL, that silly Stanford 20/20 tournamnet etc will just keep bringing them into our beloved cricket.

That is why I really do not like 20/20

Me too. I still love playing and watching football, but I support cricketers so much more. If I had to spend an evening with a football team or a cricket team. Cricket every time :)

Unless it was Durham. Harmy is clearly a right downer :p
 
what's possibly more disturbing than modi getting charged (because it's really nothing new anyway) is all the cricketers that came out testifying against him, surely the inference from this ruling is that they were bought?

I'd like to know why their testements were dismissed anyway, as surely that would indicate a far greater crime than slandering a cricketer.
 
The full 46 page judgement is available online. It's fairly scathing about the integrity of the witnesses.
He also addresses the libel tourism point saying Cairns and Modi both live in the UK, Cairn's spent a large part of his career living here and raising a family etc.
 
are any of the witnesses still employed as cricketers? I know a lot of ICL players got banned and I'd imagine a fair portion were unable to find a club after they'd served their bans.

if they were indeed bought, it's another worrying example of how receptive cricketers are to corruption.
 
Those witnesses seemed like such upstanding criminals, er.. I mean, citizens too. It was probably all just misinterpretation caused by the language barrier, cultural differences and a faulty translator. The "get out now" command? It was actually "get out there now.. [you've been promoted]". Innocent mistakes like that, that resulted in this whole libel misunderstanding.
