Well, it's understandable that they hadn't written the rule correctly for two reasons: (i) they're the ICC and (ii) they hadn't envisioned what sort of situation the need to apply that rule would be. This is why rules should be thought of more as guidelines. Of course, this makes everyone unhappy because there is suddenly a lot of bias involved.
