I have written couple of poems ( it's not good, but that's not the point ) and I am not gay.

Nope, they don't just the top part or the area they can see. The state will always truly own the 'land' I work for a mining Corp (mostly open caste) but this depends on the countries laws and the land registry. But this can be by-passed with compulsory purchasing.
