Kshitiz, the business tycoon who has the name sponsorship rights of the Termite Toronto Tanks, and quite recently acquiring the Sydney McStallions sponsorship from the Vatican Victors, has sued the Sydney McStallions for continued denial of using the name given to them by the sponsor. The proof has been attatched -











As you can see in the above attatched proof(Just because they don't go around editing their posts. ;)), its clear that they have been given ample warnings and even sued in the past where they failed to pay the vCash. The team name was "The Losers that are the Sydney McStallions" but they only named "Losers Sydney McStallions". Although we understand the reason for this (The thread name doesn't get any longer) but there attitude is flawed. Had they been in the right attitude they would have atleast put it back after a few days( They had a big Register your interest blah blah blah line in their thread title), as its been clearly a LONG time since then.

Therefore, for the above mentioned charges(Breach of contract and continously refusing to use the name), and also the failure to pay the earlier vCash compensation, the sponsor now asks for a compensation of 1.5 Million vCash for the inconvienience caused and breach of contract penalty.

The sponsor urges the PCPL board to respond and get him justice.
 
The PCPL have tonight stated,

"Our lawyers will look into the matter! It is only right that the Sydney based team have time to respond."

This is a first for the PCPL and Barrow did state that, "if this goes to court, it will be held in the premises of PlanetCricket chat (if it still exsists)."

The tycoon Kshitiz states that he's delighted to get an early response from the PCPL board and hopes he will get justice. :)
 
Absolutely. The Losers that are Sydney McStallions have repeatedly breached, and it is fitting that the sponsors sue them.
The sponsors have paid them for their name, and if they don't get their wish, whats the use of the sponsorship?

This is a serious offense and 1.5mn demanded by Kshitiz is very well Justified.
 
PCPL board should also get some money for inconvinience caused to them by repeated court visits due to The Losers that are Sydney McStallions.
 
Sydney McStallions Owner Dean Sherr (QC) has shot back at supposed sponsorship agreement violations in a statement prepared by the Stallions' legal team.

Sherr stated the following evidence:
-There had been no binding contract signed in the first place.
-The verbal agreement reached had not included any details regarding the use of the sponsorship name,

Sherr also said that the sponsors had been a huge bother, that they had already been appeased when the Stallions had agreed to remove the [] engulfing the sponsorship name, despite the fact that the original agreement had been using them.

The original agreement was this:
If you're looking for sponsors, I'll pay you 35k for the name sponsorship i.e [?] Sydney McStallions with the [?] depending on what I want.
AND THEN
Okay Dean we're on deal with 55k. I'll send money as soon as you send me a PM regarding the confirmation.

I'll retain the right to keep the [?] in [?] Sydney McStallions whatever I want.

The [] were clearly not elaborated on, which Sherr QC called an 'amateur's mistake.' The agreement that the Stallions would later remove the brackets for free was called a 'goodwill gesture' and he called the lawsuit baseless and outrageous.

"They never asked stated that we had to call the team their name at every opportunity, and as such they have no claim. If they wanted that, they should have negotiated it."
 
The tycoon, Kshitiz has responded to the defence the McStallions have put up.

He says that they have contradicted themselves in their own statement. They were quoting Kshitiz on saying this : -

The statement clearly means that Kshitiz had said that in the name sponsorship, there name would be [?]Sydney McStallions, with the choice of [?] remaining with Kshitiz. Note it people, he had said that he would retain changing the [?], and not only ?, clearly indicating that their argument on the brackets was completely baseless and it was just meant to lure more money out of the sponsor.

Kshitiz was also quoted saying :-
Had the Sydney McStallions been pure businessmen they would have never resorted to such cheap means of making money in the first place. Take the Myopic Manchester Monkeys for example - they have never violated the rule even though there has clearly been no public indication of negotiations which Mr. Sherr claims should have been made in our case. I feel that this is completely ridiculous and they're just trying to shake us off their back with baseless things.

Kshitiz was also outraged about the cheap means and ridiculous attitude the Sydney's so called "Legal Team" had shown in the statement, and he quoted them saying -

This is ridiculous. Already I was paying them 10k per name change even though it wasn't deserved in the first place, but just to be the right business and keeping my word, I agreed to do it. Now they are claiming about a "supposed non-signed contract". Well then, tell me how to sign contracts on the internet other than the posts made and the donation log, and I'll gladly do it. This argument is completely baseless.

The tycoon also quoted a past incident where the Sydney team had caused problems with the contract and The PCPL had to interfere in it - The proof for that can be found here.

SYDNEY McSTALLIONS CAPTAIN COULDN'T GIVE A RAT'S ARSE

The captain of the Sydney McStallions (a.k.a. the McStallions from Sydney) has come out and said this in a Sydney McStallions press conference "I, not on behalf of the Sydney McStallions, but only on behalf of myself, a member of the Sydney McStallions, am not too fussed about the whole Sydney McStallions naming situation. I was once a fan of Kshitiz_Indian's name for the Sydney McStallions, and thought it'd be funny, but now he has kicked up a stink I am quite deliberately antagonising him by calling us the Sydney McStallions. Until he takes a chill pill I will continue to call us the Sydney McStallions. We are the Sydney McStallions, and I dare you all to try and get one of us out."

Without meaning to influence the statement, the Sydney McStallions think it is awesome when people spell definitively wrongly. Quite a turn-on, in fact.

I can't be bothered writing in the 3rd person anymore, so:

Firstly, you agreed to pay for name changes. 'Deserving' means nothing, because we negotiated that.

Second, what the Monkeys do is irrelevant. If you want to know about businessman in the world, then you shouldn't talk about the spirit of the game and making money fairly. A good businessman is one who cheats at every opportunity. The above examples are clearly mistakes, and all but one were made by np anyway, so it's not my fault.

However, there was no agreement made that we have to mention your sponsorship name every time we say the Sydney McStallions. Why should I do it just because the Monkeys do it? Had you said that it was part of the agreement, we would've done it, but you didn't.

In spite of all this, as a goodwill gesture, with no admission of guilt or liability, sealed, and this offer goes off the table at midnight tonight, we're prepared to offer you 5 vCash.
