It would be so cool if big ant could somehow negotiate a deal with the different bat brands, so we could have these fantastic mods on console, even if it was only for the older type bats or just basic real life branding. Same with kits, if whomever owns the rights to current kit licenses doesn't want to allow BA to aquire the licence, maybe BA could aquire the old logos, eg ACB instead of CA and TCCB instead of ECB, maybe the MCC holds those rights still, and as they're no longer in circulation it may be possible to have those in DB 16?
Unfortunately the issue here is who owns the Intellectual Property (IP)? In most cases, even if the emblem/logo is superseded, the original creators or owners retain the rights. The cost of obtaining these rights is commonly dictated by market forces (supply/demand) and given that high end media outlets have in recent years paid extortionately high amounts of money for the rights to print or broadcast as "Official Media Partners", it often prices software developers out of the market, as to obtain rights will see them considerably exceed their budgets.
Occasionally we do see limited licencing, such as 'Ashes Cricket 2013', however this also brings no guarantees of quality control or inducements to the owners of the IP that their brand will be enhanced. There could be an argument that with Ashes Cricket 2013 the scandal surrounding the finished product risked damaging the brands of Cricket Australia and the ECB as it was obvious that quality control standards were not met prior to release, and as I recall the product was removed from the market shortly after release.
The reality is that Official Licencing is now so expensive the compromise of opening the game to modification by users at least allows a level of opportunity to add representations of different brands without the IP law breaches. Providing that each modification remains without charge to the user, then under many jurisdictions there is no IP law breach.
Perhaps another way of being able to make the mods available to console users is for an expansion of the DBC Academy for a mod to be uploaded like a player or team, in a particular format that can then be then processed by the Academy and then downloaded by the console user?
I am very much in favour of console users being able to use these mods or have Official Licencing, mainly out of a sense of fairness and that it enhances the playing experience, however the cost involved to make this happen needs to be affordable to the developer, otherwise we may not have the game to use at all.
It should be noted that as has been stated before, rarely if at all, console games are unable to be modified and this point unfortunately needs to be accepted by the user.
Who knows what the future holds though? Bring on DBC 16!
