Yup, just like Madden does with "online pass". The problem with that approach is what do you do with used games? Say I buy a 2nd hand game legally from a retail store but the online pass/activation code is already used up by the original owner. What happens then?
I sincerely feel that the developer 'should' get some benefit of a second hand sale as well. There is a very thin line between piracy and game sharing actually (I dont see any difference in it though as it is just killing the sale of an original copy).
Think of online as a 'premium' feature. Some developers/publishers host online games on their own servers as well which involve costs....how will they recover it if people use that feature without paying anything for it! You can still buy a second hand game and pay a small fee to use the 'premium' online feature!
